Terms of Use

1. Operator and scope

Kestivo is operated by:

These terms apply to:

• the public website at kestivo.app;
• the Kestivo private-beta waitlist and related beta communications; and
• the Kestivo iOS application when Kestivo provides private-beta access to you.

Commercial subscription terms, paid-service terms or other product-specific terms may be introduced separately before Kestivo offers paid services. Mandatory consumer rights remain unaffected.

2. Development and private-beta status

Kestivo is in active development and pre-release testing. Product descriptions, screenshots, algorithms, AI behaviour, Roadmap logic, weekly-planning behaviour, integrations, availability, user interface, data structures and release timelines may change.

A private beta is provided for testing, product validation and early athlete use. Beta functionality may be incomplete, unavailable, inaccurate or subject to breaking changes. Kestivo does not promise uninterrupted availability, a particular release date or permanent retention of every beta feature.

Nothing on the website constitutes a guarantee that a feature, provider integration, performance outcome, training adaptation or commercial product will be released in a particular form or at a particular time.

3. Beta waitlist and invitations

The waitlist records interest in possible Kestivo private-beta participation and relevant Kestivo development updates. Joining is free and does not create an app account, paid subscription, pre-order, reservation or guaranteed entitlement to beta access.

Registration uses double opt in. You must use an email address you are entitled to use. You may leave the waitlist at any time using the unsubscribe option in an email or by contacting Kestivo.

Private-beta invitations may be offered in phases. Selection can take into account product readiness, testing capacity, platform and device compatibility, sport profile, integration availability, geography and other legitimate testing considerations. Kestivo may postpone, limit, close or discontinue beta access.

4. App accounts and account security

Where Kestivo private-beta access requires an account, you must provide accurate information and keep your login credentials confidential. You are responsible for activity performed through your account unless applicable law provides otherwise.

You must not share authentication credentials, attempt to access another user's account, circumvent authentication or security controls, or interfere with Kestivo's Row Level Security, backend functions or integration authorization mechanisms.

If you believe your account or credentials have been compromised, contact hello@kestivo.app promptly.

5. Training-planning service

Kestivo is designed to assist endurance athletes with athlete-profile management, race-oriented Training Roadmaps, weekly planning, workout structure, training calendars, completed-training history, planned-versus-actual review and related training-load or physiology information.

Kestivo can use athlete-provided information, completed-training evidence, deterministic calculations and AI-assisted generation. Missing or uncertain data can reduce the specificity or availability of certain functions.

The athlete remains in control of training decisions. Kestivo is not a substitute for an in-person coach, physician, physiotherapist or other qualified professional where professional assessment is appropriate.

6. AI-assisted planning

Kestivo uses AI-assisted generation for parts of the planning workflow. AI-generated Roadmaps, weeks, workouts, explanations or other content may be incomplete, inconsistent or unsuitable for an individual athlete.

Kestivo's product principle is that AI drafts, Kestivo applies deterministic validation, and the athlete reviews and approves. AI output is not intended to modify the athlete's operative training calendar without the required Kestivo validation and athlete-controlled action.

You must exercise reasonable judgement when reviewing generated training. You should not rely on AI output as medical advice, a diagnosis, an injury prediction, a guarantee of recovery, or a guaranteed race-performance prediction.

7. Training and health disclaimer

Endurance training creates physical stress and carries risks including fatigue, overuse, acute injury, illness, environmental exposure and equipment-related hazards.

Kestivo does not provide medical diagnosis, medical treatment, emergency services or individual medical advice. Training-load, ATL, CTL, TSB, confidence and similar metrics are decision-support information for training planning and are not medical-device readings or complete measures of health or readiness.

You remain responsible for deciding whether a training session is appropriate for your health, experience, current condition, environment and equipment. Stop training and seek appropriate professional or emergency assistance if you experience concerning symptoms. If you have a medical condition, injury, symptoms, pregnancy-related concerns, or uncertainty about exercise safety, obtain advice from an appropriately qualified healthcare professional.

8. Third-party integrations

Kestivo may interoperate with third-party platforms and devices. Availability is subject to provider approval, APIs, platform policies, user permissions, compatible devices, technical access and continued provider support.

Apple Health / HealthKit

Kestivo's current private-beta architecture can read permitted completed-workout information through Apple Health / HealthKit after the user grants the relevant iOS permissions. The exact data available depends on the originating device or app and Apple's platform behaviour.

Garmin

Direct Garmin Connect integration is planned and subject to Garmin Developer Program approval and implementation. Kestivo intends to use Garmin activity data for completed-workout ingestion and Garmin training functionality for structured-workout delivery where approved and technically supported. References to Garmin do not imply current approval, sponsorship, endorsement or affiliation.

Other services

Strava and other provider integrations remain future candidates unless Kestivo explicitly states that an integration is available.

Third-party services are governed by their own terms, privacy policies, account requirements and technical limitations. Kestivo is not responsible for outages, data omissions, provider policy changes or functionality controlled by those third parties.

9. Permitted use

You may use Kestivo only for lawful personal testing and training purposes consistent with the access provided to you.

You must not:

• attempt unauthorized access to Kestivo, another account, databases, backend functions or provider integrations;
• circumvent security, rate limits, feature entitlements, beta restrictions or access controls;
• introduce malware, automated abuse, denial-of-service traffic or other harmful code or activity;
• scrape, probe or reverse engineer Kestivo except to the limited extent such restriction is prohibited by mandatory law;
• use Kestivo to infringe third-party rights or applicable law;
• misrepresent affiliation with Kestivo or another provider; or
• submit another person's health, training or account data without a lawful basis and appropriate authority.

10. User-provided content and beta feedback

You retain ownership of text, notes, training information and other content that you provide to Kestivo, subject to rights held by third parties.

You grant Kestivo the limited rights necessary to host, process, transform, display and otherwise use that content to provide, secure and improve the service in accordance with these terms and the Privacy Policy.

If you voluntarily provide product feedback, bug reports, feature suggestions or usability observations, Kestivo may use that feedback to develop and improve Kestivo without an obligation to compensate you. This does not give Kestivo unrestricted rights to use your personal, health or training data outside the purposes described in the Privacy Policy.

11. Intellectual property

Kestivo software, branding, product design, original website content, interfaces, graphics, documentation and other Kestivo materials are protected by applicable intellectual-property laws.

Private-beta access gives you a limited, personal, non-exclusive, non-transferable and revocable right to use the Kestivo app and service for the intended beta purpose. No ownership rights are transferred.

Third-party trademarks and platform names remain the property of their respective owners.

12. Privacy and health data

Personal-data processing for the website, waitlist and Kestivo iOS application is described in the Kestivo Privacy Policy. The Privacy Policy includes information about account data, athlete profiles, training and health data, Apple Health / HealthKit, AI-assisted planning, OpenAI, planned Garmin processing, retention and user rights.

Optional health or connected-service access is subject to the permissions and consent mechanisms applicable to the relevant feature. Revoking an integration can stop future access without automatically deleting previously imported Kestivo data, as described in the Privacy Policy.

13. Availability, maintenance and product changes

Kestivo may perform maintenance, deploy new versions, change AI models, modify algorithms, update training methodology, change integrations, impose usage limits, replace beta features or correct data and software defects.

Kestivo does not guarantee that the website or beta app will be uninterrupted, error-free or compatible with every iPhone, iOS version, wearable, third-party service or network environment.

Where reasonably possible, Kestivo will aim to avoid unnecessary loss of athlete data. Beta status nevertheless means that users should not treat Kestivo as the sole repository of information they cannot afford to lose.

14. Suspension and termination

You may stop using the website, leave the waitlist or stop using the beta app at any time. Account and personal-data deletion is handled in accordance with the Privacy Policy and applicable law.

Kestivo may suspend or terminate beta access where reasonably necessary for security, abuse prevention, legal compliance, serious breach of these terms, provider restrictions, discontinuation of the beta or technical/product reasons inherent in pre-release testing.

Where appropriate and legally required, Kestivo will take account of proportionality and applicable consumer rights.

15. Apple and platform terms

If Kestivo is distributed through Apple's TestFlight, App Store or another Apple service, applicable Apple platform terms may also govern distribution, installation and use. Apple is not responsible for Kestivo's own training-planning service except to the extent mandatory platform or legal rules provide otherwise.

These Kestivo Terms do not alter rights or obligations that cannot legally be modified under applicable Apple platform terms or consumer law.

16. Liability

Kestivo is liable without limitation for intent and gross negligence; injury to life, body or health; liability under mandatory product-liability law; guarantees expressly assumed by Kestivo; and other cases in which liability cannot legally be excluded or limited.

For slight negligence, Kestivo is liable only for breach of a material contractual obligation whose fulfilment is essential to proper performance and on whose observance the user may regularly rely. In such cases, liability is limited to the foreseeable loss typical for the contractual relationship, unless mandatory law requires otherwise.

The foregoing limitations do not restrict mandatory consumer rights. Where no contractual relationship exists, liability is governed by applicable statutory law.

17. Payments and subscriptions

The current Kestivo private beta does not, by these terms alone, create a paid subscription or payment obligation.

If Kestivo later introduces paid access, subscriptions or in-app purchases, the applicable price, billing period, cancellation rights, renewal rules and any required consumer information will be presented separately before a paid contract is concluded.

18. Consumer dispute resolution

Kestivo is not willing or obliged to participate in dispute-resolution proceedings before a consumer arbitration board unless a mandatory legal obligation applies in an individual case.

The former European Commission Online Dispute Resolution platform was discontinued on 20 July 2025.

19. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer-protection provisions of the country in which you have your habitual residence remain unaffected.

Any mandatory rules on jurisdiction remain unaffected.

20. Changes to these terms

Kestivo may update these terms where reasonably necessary because of product development, beta scope, integrations, legal requirements, security, new features or the introduction of commercial services.

The current version and update date are published on this page. Where applicable law requires explicit notice or acceptance of material changes, Kestivo will provide it before the changes become binding.
