1. Scope

These terms apply to use of the public Kestivo website at kestivo.app. They are not yet the end-user licence, beta, subscription or app-specific terms for the future Kestivo iOS application.

2. Development status and no automatic contract

Kestivo is under active development. Product descriptions, screenshots, planned integrations, beta references, features and timelines are informational and may change.

Visiting the website, contacting Kestivo or expressing beta interest does not create an entitlement to the application, a beta place, a release date, a particular feature or a commercial offer.

3. AI-related product information

The website describes planned AI-assisted training-planning capabilities. AI-generated plans and workouts may be incomplete, unsuitable or incorrect and must be validated by Kestivo and reviewed by the athlete before use.

The public website itself does not currently provide individual AI planning, medical advice or an automated coaching service.

4. Training and health disclaimer

The website provides general information about a planned endurance-training product. It does not provide medical diagnosis, treatment or individual medical advice.

Endurance training involves physical stress and risk. Athletes remain responsible for assessing whether training is appropriate for their health, experience, environment and equipment. Anyone with symptoms, health concerns or uncertainty should obtain advice from a qualified medical professional before training.

5. Third-party integrations

References to Garmin, Apple Health, HealthKit, Apple Watch, Strava or other services describe planned or evaluated integration paths. They do not imply current availability, provider approval, sponsorship or endorsement.

Integration availability depends on APIs, provider approval, platform rules, devices, user permissions and continued technical access.

6. Intellectual property

The website, Kestivo branding, original text, layout, graphics and product materials are protected by applicable intellectual-property laws. Rights not expressly granted remain reserved.

7. Permitted use

You must not attempt unauthorised access, introduce malicious code, interfere with availability, circumvent security measures, misrepresent affiliation with Kestivo or use the content unlawfully.

8. External links

External websites are operated under the responsibility of their providers. Kestivo does not control their content, availability or privacy practices and does not adopt such content merely by linking to it.

9. Availability and accuracy

Reasonable care is taken when preparing the website. Kestivo does not guarantee that all information is complete, current, continuously available or free from technical errors. Planned functionality may change without notice.

10. Liability

Kestivo is liable without limitation for intent and gross negligence, injury to life, body or health, mandatory product-liability law and other cases where liability cannot legally be excluded or limited.

For slight negligence, Kestivo is liable only for breach of an essential contractual obligation, limited to the foreseeable loss typical for the relationship. Where no contract exists, liability is governed by the applicable statutory rules.

11. Privacy

Website processing is described in the Privacy Policy. Separate or expanded information will be published before app accounts, AI planning, beta access, health data or training data are processed for external users.

12. Consumer dispute resolution

Kestivo is not willing or obliged to participate in dispute-resolution proceedings before a consumer arbitration board unless a mandatory obligation applies in an individual case.

The former European Online Dispute Resolution platform has been discontinued and is not linked from this website.

13. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the consumer's country of habitual residence remain unaffected.

14. Changes

These website terms may be updated when the website, product status or legal requirements change. The current version and date are published here.
